6.2. Nothing in these Terms of Use shall exclude or limit Bipolar Edinburgh’s liability for:
6.2.1. Death or personal injury caused by the negligence of Bipolar Edinburgh and/or its trustees’ negligence; or
6.2.2. Fraudulent misrepresentation by Bipolar Edinburgh and/or its trustees.

These Terms of Use shall be governed by, and construed in accordance with, Scottish law and the courts of Scotland shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms of Use and the use of this Website, unless Bipolar Edinburgh shall elect to bring proceedings in the courts of the country of the user's residence or principal place of business.

8.2. No delay or indulgence by Bipolar Edinburgh in enforcing the provisions of these Terms of Use shall affect Bipolar Edinburgh’s rights under them nor shall any waiver of Bipolar Edinburgh’s rights operate as a waiver of any subsequent breach.
